A. BOOKINGS AND PAYMENTS
1. Deposits and final confirmation
Payments made before the Agency’s final confirmation of services are treated as deposits toward the total amount due. Final confirmation of services and prices will take place upon full payment of the agreed price, issuance of tickets and/or service vouchers, and issuance of the corresponding invoices.
2. Changes to prices and reservations
Prices and reservations for tours or individual services may be modified without prior notice if services, costs or anticipated exchange rates change for reasons beyond the parties’ control.
3. Credit transactions
Credit transactions must comply with the applicable requirements. Customers must pay the price and any outstanding balances within the deadlines and under the conditions established by the financing banks.
The Agency is responsible for providing professional information about the products and services it sells, including trip details and information about the personal documents, visas and immigration procedures required to enter or transit through destinations outside Argentina.
4. Quoted fares
When providing a quotation, the website and/or sales representative will offer the lowest fare available at that time through the GDS (Global Distribution System) for air travel and/or ground services.
Such fares generally do not permit changes or refunds. At the service provider’s discretion, changes may be permitted subject to penalties and/or fare differences, or refunds may be available subject to penalties. These conditions are beyond the Company’s control.
Since 2020, promotional fares such as “Superflex” or similar have been introduced. Passengers acknowledge that such promotional fares are subject to the conditions and restrictions established by the relevant carrier, operator or service provider.
5. Foreign-currency quotations and payments
Services provided abroad are quoted in foreign currency, as are block-seat and charter flights, in accordance with Resolution 7/2002.
Payments are accepted in Argentine pesos at the exchange rate applicable at the time of payment and are credited toward the total amount quoted in foreign currency. Any outstanding balance must be paid in Argentine pesos at the exchange rate applicable when the funds are effectively credited to the Company’s designated accounts.
If a passenger pays in foreign currency and subsequently withdraws from or cancels the services, refunds will be made in legal tender, in accordance with Article 765 of the Argentine Civil and Commercial Code.
6. Cash payments and foreign-exchange regulations
Passengers paying in cash are subject to AFIP Resolution 3825/2015 and any future regulations on the matter.
Passengers purchasing services abroad acknowledge that foreign-exchange restrictions may apply as a result of government measures beyond the Company’s control. Applicable tax collection rules under AFIP General Resolution 4815 must also be observed.
B. WHAT IS INCLUDED IN THE PRICE
The price includes the services expressly specified in the relevant itinerary and booking documentation.
These may include:
* Round-trip transportation, when expressly included, with the type, characteristics and class specified in the service details. Transportation may be scheduled, charter or block-seat, with or without stops and connections.
* Travel assistance, where applicable and expressly stated in the relevant voucher.
* Accommodation at the hotels listed in the itinerary or, in the event of a change, at hotels of the same or a higher category.
* Single, double or triple rooms according to the number of occupants, with private bathrooms and taxes included, unless otherwise expressly stated or local overnight taxes are payable directly by the passenger.
* Meals according to the applicable programme.
* Visits and excursions expressly listed.
* Transfers to and from airports, terminals and/or hotels when specified.
The number of accommodation days is the number stated in the service voucher. Hotel stays generally begin at 3:00 p.m. and end at noon the following day, regardless of arrival or departure times or whether the accommodation service is used in full or in part.
Local hotel regulations may establish an earlier check-out time. Where this applies, the hotel will advise the passenger of the applicable departure time upon check-in. The Company cannot change these local requirements or make special arrangements in this regard.
After the applicable check-out time, the passenger must pay the hotel the current rate, which may differ from the rate paid to the Agency.
The duration of a tour is calculated from the first day stated in the travel documents through the last day at the destination, regardless of actual departure or arrival times.
Triple rooms are often configured as a double room with an additional foldaway bed. This arrangement may reduce comfort, and the passenger accepts this limitation and releases the hotel, the Company and the wholesaler from responsibility in this respect.
In the United States and Mexico, rooms may contain two queen-size beds and accommodate one to four people at the same rate. Where the designation “DBLFP” is used, it refers to a room accommodating up to two adults and two children aged 12 or younger, subject to applicable health regulations and until further notice.
Hotel categories are the official classifications assigned by the tourism authorities in the relevant location. The Company is not responsible for the criteria used by those authorities to award or supervise such classifications.
C. SERVICES AND ITEMS NOT INCLUDED
Unless expressly stated otherwise, the following are not included in the quoted price:
1. Personal expenses and additional charges
Extras, beverages, meals, laundry and ironing, tips, personal expenses, excess baggage, telephone calls, airport taxes, penalties for failure to complete online check-in, tolls, service taxes, VAT and other taxes, customs and immigration charges, booking-management fees, vaccinations, tests and medical analyses, health-related entry or return requirements, current or future tax withholdings or collections, urgent or express travel-document fees, and any service not expressly listed in the Company’s service order.
2. Additional activities and disruptions
Museum, archaeological-site, attraction and national-park admission fees; optional excursions; local tourism taxes and fees; communications; and additional expenses resulting from cancellations, delays or unforeseen circumstances beyond the Company’s control.
3. Meals during transportation
Meals during the journey, unless expressly included in the programme.
4. Credit costs
Expenses and interest associated with credit transactions.
5. Visas and entry authorizations
Visa fees and entry authorizations required by the destination, such as ESTA, where applicable.
6. Voluntary extensions and unforeseen circumstances
Expenses arising from extensions of services or stays requested voluntarily by passengers, force majeure or circumstances beyond the reasonable control of the organizer, including situations in which passengers are stranded under government-imposed health measures.
Any item not specifically listed in the relevant itinerary is also excluded.
7. Car rentals
Fuel, tolls, GPS, taxes, accident or damage excesses or deductibles, theft-related charges, and optional or mandatory insurance are excluded unless expressly specified otherwise.
8. Seat selection and additional baggage
Airline seat-selection fees and additional baggage are excluded. Passengers should verify whether the selected fare includes at least one item of baggage if required.
The Agency may request the passenger’s preferred seat from the airline, which may involve an additional fee. However, the Agency cannot guarantee that the airline will assign the requested seat.
9. Travel assistance
For their own safety, passengers must arrange travel assistance appropriate to the nature of the trip, destination and required coverage, including Schengen-related requirements for travel to the euro area and requirements imposed by other destinations.
Coverage should specifically address pandemic-related assistance and unexpected trip cancellations resulting from border closures.
The Agency is not responsible for circumstances covered by travel-assistance services. Passengers must select coverage appropriate to their age and health circumstances.
D. LIMITATIONS ON THE RIGHT TO REMAIN ON A TOUR
The Company or local operators may require a passenger to leave a tour or tourist service at any point along the itinerary if disruptive conduct, behaviour, health conditions or other serious circumstances, in their reasonable judgment, endanger or inconvenience other travellers or jeopardize the successful or normal operation of the excursion.
In such cases, the penalties set out under “Alterations or Modifications” shall apply.
Passengers must act in good faith and respect other members of the group, their belongings, hotel facilities, transportation, places visited, excursions and guides. All passengers must observe standards of conduct that promote safe and harmonious group travel.
Passengers must also comply with health and safety measures imposed by destination authorities, hotels, airlines, transport providers, restaurants and other relevant parties. Passengers are responsible for completing any health tests required by the relevant authorities or travel-related companies.
Passengers should always check whether service providers or authorities impose health requirements for entry based on nationality or other circumstances.
E. TRAVEL DOCUMENTATION
For international travel, the Agency provides information regarding the applicable rules for the chosen destination. Passengers must pay particular attention to the legislation in force.
The Company states that it provides clear information sufficiently in advance about immigration, customs and health requirements applicable to the destinations included in the tour. However, passengers are solely responsible for holding the personal documents required by the relevant authorities.
Passengers must obtain and present the required documentation whenever requested by immigration, police, health or other competent authorities. They are responsible for obtaining any health passport required by the origin or destination of the trip.
Passengers must ensure that they understand the documentation, visa, vaccination and immigration requirements of foreign countries. The Company accepts no responsibility for deficiencies in documentation, processing errors, missing visas, incorrectly issued personal documents, expired passports or other travel documents, or permissions required for minors.
If incorrect or missing documentation, visas or vaccinations prevent a passenger from departing, entering, remaining in or transiting through a country, the conditions under “Alterations or Modifications” shall apply.
The original terms refer passengers to official Argentine government websites for passport applications, expedited passports, visas and travel authorizations. These references and their current validity should be checked before publication.
Passengers travelling with minors must carry all documentation required by the immigration authorities. The original terms also recommend consulting official traveller-health information and the Argentine Ministry of Foreign Affairs regarding destination-specific requirements and alerts.
Passengers must comply with applicable health and immigration forms and follow the instructions issued by the authorities.
Passengers are responsible for accurately providing the Agency with all personal information for themselves and their fellow travellers, including full names, nationality, document types and numbers, valid and legible passports and other travel documents, and contact information required by airlines, carriers and operators under applicable international passenger-name-record (PNR) rules.
Passengers must inform the Agency in writing of any special assistance required during flights, at airports or on excursions. Certain destinations, sites and excursions may be difficult or inaccessible for people with reduced mobility. Where a local operator cannot provide a service for practical reasons, the passenger will be informed of the relevant limitations. Under the original terms, services not provided in these circumstances are non-refundable.
The original terms also set out documentation and authorization requirements for minors under 18 travelling abroad from Argentina. These requirements depend on the circumstances of the trip and the applicable rules. Passengers should verify the current requirements with the competent Argentine authorities before departure.
Where a minor travels with both parents, the original terms refer to identity documents and visas for the family group, together with documents proving the family relationship, such as a marriage certificate, birth certificate or other legally recognized documentation.
Where a minor travels with only one parent or a guardian, the original terms refer to authorization from the parent who is not travelling, duly certified in accordance with the applicable rules. If a parent has died, the relevant death certificate must be provided.
The original terms also state that travel documents must contain an up-to-date photograph of the minor. For travel authorizations intended for English-speaking countries, the terms refer to translation by an Argentine sworn public translator and legalization of the translator’s signature.
The websites mentioned in the original terms are provided as informational references and may change without notice. The Agency and the passenger are responsible for obtaining information from the relevant official authorities.
The original terms refer to a migration affidavit introduced on 7 September 2020. This provision and all linked government procedures must be checked for current validity before publication.
The Company accepts no responsibility for the processing or validity of the travel documents of passengers or their companions, or for any resulting inconvenience. Passengers bear the costs arising from delays or abandonment of a trip caused by missing or deficient documentation.
F. CANCELLATIONS
1. Cancellation of confirmed services
Where a cancellation affects services firmly booked by the Agency, any refund requested before travel is subject to the contractual conditions of the relevant service providers, hotels and destination operators.
Where refunds are due, the Agency may retain the expenses incurred plus a commission of 10% of services contracted with third parties, as referenced in Article 21 of Decree 2182/72.
Cancellation periods begin when the Company receives verifiable notification of the cancellation.
Cancellation penalties and deposits paid to register for a tour or itinerary are non-refundable and cannot be credited toward future bookings.
Air tickets are subject to the applicable air-transport contract and the conditions of the fare purchased by the passenger. The original terms state that quotations are based on the lowest available fare.
2. Cancellation of credit transactions
For cancelled credit transactions, amounts paid to the Agency for information, administrative expenses, stamps and interest, where applicable, are non-refundable.
3. Special services and events
Passengers must pay particular attention to the conditions applicable to the specific services contracted, including hotels, cruises, ski resorts, insurance, domestic or international scheduled and charter flights, and special events such as New Year’s celebrations, Carnival, Mardi Gras, boat shows, trade fairs and conferences.
Each provider may impose its own booking and cancellation conditions. The original terms state that hotel services cancelled during special events are non-refundable.
4. Charter, non-scheduled and block-seat flights
The rules established by the carrier under the relevant air-transport contract apply, including the regulations referenced in the original terms.
For group travel, the applicable payment methods and deadlines established by the carrier must be communicated in advance to the Agency and travellers. Flight delays are governed by the applicable air-transport contract.
Passengers who fail to appear for boarding or to use services at the specified time and place will be considered “no-shows” and may lose the full value of the air service. The applicable conditions also apply to missed ground transportation or hotel services.
5. Cancellation when the minimum group size is not reached
If an excursion is cancelled because the minimum number of passengers is not reached, or for another justified reason, registered passengers are entitled only to a refund of the amounts paid up to the date of notification. The original terms also refer to Article 24 of Decree 2182/72.
6. Voluntary non-use of services
Passengers who voluntarily choose not to use one or more contracted services during the trip are not entitled to a refund or compensation for those services.
7. Cancellation penalties
Unless the provider establishes different conditions for a specific service and informs the passenger at the time of booking, the original terms specify the following penalties for cancellations initiated by the passenger:
* More than 30 calendar days before the start of services: 40% of the total purchase price.
* Between 29 and 15 calendar days before the start of services: 50%.
* Between 14 and 5 calendar days before the start of services: 70%.
* From 4 calendar days before the start of services through the final day of service: 100%.
These penalties apply in addition to any different penalties imposed by operators or service providers and any specific terms disclosed at booking. Amounts retained as cancellation penalties and booking deposits are non-refundable and cannot be credited toward future bookings.
Air tickets are subject to the fare rules of the relevant airline. For travel involving maritime services, the terms established by the shipowner or operator also apply to travel conditions and cancellation penalties.
G. TRANSPORTATION: SCHEDULED, NON-SCHEDULED AND CHARTER SERVICES
The cancellation provisions above apply. Where relevant, refunds may be limited to the portion of the price attributable to ground services, such as accommodation, meals and excursions, as determined by the organizer and according to the service provider’s operating arrangements.
The Agency provides passengers with the trip details in the initial document or information it issues. Airlines and transport providers may nevertheless change schedules, postpone or cancel services, or change the facilities and equipment used.
The Agency accepts no responsibility beyond providing the required information. Air transportation is governed by the applicable air-transport contract and the legal limitations referenced in the original terms, including the Montreal Convention, Law 26,451, Resolution 1532/98 and National Decree 1470/97, as amended. Ground transportation is governed by the Argentine Civil and Commercial Code and Law 26,994.
The original terms state that an airline ticket is valid for one year from its date of issue, regardless of the departure and return dates, and constitutes the contract between the carrier and passenger once issued. They recommend purchasing insurance covering transport cancellation charges when booking and paying for other services. Claims must be submitted to the relevant insurer.
For air, land, rail, lake, river or sea transportation, the applicable contract and governing laws determine any compensation payable by the responsible provider, including the relevant currency, timing and place of payment.
Airports are subject to traffic, operational, weather and health conditions. Published schedules are approximate, and passengers must comply with the reporting times established by airlines and transport providers.
Departure and arrival times may change at the carrier’s or airport authorities’ discretion. The original terms exclude the Agency’s responsibility for such changes and their consequences for the itinerary.
The original terms also exclude the Agency’s responsibility for flight delays, schedule changes, cancellations and resulting expenses, subject to the applicable air-transport legislation. Passengers who fail to board may lose the amounts paid and the right to make changes or claims relating to block-seat or charter bookings.
Claims relating to air services should be submitted through the relevant Argentine aviation authority, as referenced in the original terms.
Baggage allowances depend on the fare purchased and the rules of the transport provider. For tours, the original terms specify one suitcase per passenger, subject to applicable weight and size limits. Baggage is carried at the passenger’s risk under the conditions stated in the original terms.
Passengers should check baggage allowances for every airline used, as weight and size restrictions may differ, especially when flights are operated by different airlines or are not included in a single reservation.
Passengers are responsible for their hand baggage and any baggage not checked in throughout the journey. The original terms exclude responsibility for baggage damage, loss or deterioration.
H. ASSIGNMENT AND TRANSFER
The passenger’s right under a tourism-services contract may be assigned or transferred to another person up to 30 days before departure, provided the carrier, hotel or service provider does not prohibit the transfer and the Company receives verifiable written notice at least 30 days before departure.
Where the passengers differ in age, applicable prices and fares at the time of the request will be applied. The Agency may charge a fee of 10% of the agreed amount for any assignment or transfer.
For international security reasons, airline and maritime tickets are not transferable to third parties. Services that providers do not permit to be transferred are likewise excluded.
I. LIABILITY
1. Role of the Company
The Company may act as a wholesaler or retailer, depending on the circumstances, but always acts as an intermediary in reserving or contracting the services included in the relevant tour or booking, such as hotels, restaurants, transportation and other providers.
Its liability is governed by the provisions referenced in the original terms, including Law 18,829, its implementing regulations, applicable resolutions of Argentina’s tourism authorities, Law 24,240 and the Civil and Commercial Code.
2. Force majeure and circumstances beyond the Company’s control
The Company is not responsible for fortuitous events or force majeure, weather or natural phenomena, pandemics or epidemics, or armed conflicts occurring before or during a tour that prevent, delay or otherwise obstruct the full or partial provision of contracted services, subject to the Argentine Civil and Commercial Code.
The Agency will inform passengers of conflicts affecting their destination. After receiving this information, passengers decide whether to proceed with the trip. All travel remains subject to the health and immigration rules in force in the origin and destination countries at the relevant time.
The Company states that it does not form part of an economic group or maintain an association with shipping companies, airlines, hotels, excursion organizers, competitions, promotions, resorts or other tour organizers, in Argentina or abroad, or with the retail travel agency marketing their services or products.
3. Travel assistance
Passengers must obtain travel assistance appropriate to their age and destination, covering the entire duration of the trip and meeting the minimum coverage required at the destination. Passengers should check whether the destination imposes additional requirements.
The original terms state that passengers who do not obtain the required assistance assume the personal risks that may arise in relation to themselves, their property or third parties. Any travel-assistance policy, including one purchased independently of the Agency, must cover pandemic-related assistance and trip cancellation or suspension, including illness caused by SARS-CoV-2.
4. Personal data
Personal data contained in travel reservations made through the Company are processed in accordance with Argentine Law 25,326 and retained for the shortest period necessary. Only data essential to completing the selected bookings will be disclosed.
Under the provisions cited in the original terms, data subjects may exercise their right of access free of charge at intervals of no less than six months, unless they demonstrate a legitimate interest, as provided in Article 14(3) of Law 25,326.
The Argentine National Directorate for Personal Data Protection is identified as the authority responsible for handling complaints concerning breaches of personal-data protection rules.
Data subjects may request the removal or blocking of their names from databases containing their information. Advertising communications by mail, telephone, email, internet or other remote means must clearly state that the data subject may request the full or partial removal or blocking of their name.
Upon request, the name of the person or entity responsible for the database that supplied the information must be provided.
J. ALTERATIONS OR MODIFICATIONS
1. Changes to itineraries
For technical, operational or force-majeure reasons, including epidemics, pandemics and health or immigration measures imposed by the countries in which services are provided, service providers reserve the right to change all or part of the daily itinerary or the services included in a tour, before or during its operation.
2. Hotel substitutions
Unless expressly agreed otherwise, listed hotels may be replaced by hotels of the same or a higher category within the same urban area, at no additional cost to the passenger.
Where such changes are made for reasons of comfort, service improvement or force majeure, the original terms state that passengers are not entitled to compensation.
3. Cancellation of tours
The Agency may cancel any tour where one of the circumstances described in Article 24 of Decree 2182/72 applies.
4. Changes initiated by the passenger after departure
Once a trip has begun, the suspension, modification or interruption of services at the passenger’s request for personal reasons does not entitle the passenger to make a claim or receive a refund.
The original text also states that interruption attributable to the passenger may have financial consequences. In all cases, the Agency undertakes to provide technical assistance within its capacity so that the passenger may continue the journey under the best possible conditions.
Passengers must bear the costs of an early return, including penalties charged by airlines.
K. ARBITRATION CLAUSE
Any dispute arising from the execution, performance, breach, extension or termination of the contract may be submitted by the parties to the National Consumer Arbitration Service, specifically the Tourism Arbitration service established by Resolution 65/2018.
The original terms also refer to the Argentine consumer arbitration system and the Arbitral Tribunal of the Argentine Federation of Travel and Tourism Companies, or tribunals operating within the relevant regional associations, where constituted.
If the parties submit to such jurisdiction, they agree to comply with the rules and conditions of the relevant arbitral tribunal, which will be provided to them in due course.
L. APPLICABLE RULES
These general conditions and the provision of services are governed by these terms, Law 18,829 and its implementing regulations, related rules, the Argentine Civil and Commercial Code and the Consumer Protection Law, as acknowledged by the parties.
All documentation generated for the passenger and delivered to the Agency in connection with the trip forms part of the travel contract and is confidential information protected by Personal Data Protection Law 25,326.
Air transportation is governed by the Aeronautical Code, the Montreal Convention and Resolution 1532/98, as referenced in the original terms.
Payments are subject to the applicable communications of the Central Bank of Argentina regarding foreign-currency transfers, together with the Civil and Commercial Code provisions governing monetary obligations in legal tender or foreign currency.
M. ACCEPTANCE OF THE BOOKING CONDITIONS
Payment of the registration fee or travel deposit constitutes the passenger’s and Agency’s acknowledgment and acceptance of these terms and conditions.
All services offered are subject to the terms, cancellation and refund policies established by tour operators and airlines, as well as health measures imposed by the government and immigration authorities of the relevant destinations, whether domestic or international. The applicable conditions are to be disclosed before purchase for each individual offer.
These general conditions may be communicated in person, digitally, by email, WhatsApp, booking forms or another method agreed upon by the parties. They are also published on the Secontur S.R.L. website, as referenced in the original terms under Article 4 of Law 24,240, as amended by Article 169 of Decree 27/2018 and Resolution 915-E/2017.
